These Terms of Service, including the Shipping Terms & Conditions below (together, the "Terms"), are a binding agreement between you ("Customer," "you," or "your") and Baltic Auto Shipping, Inc. ("Baltic Auto Shipping," "we," "us," or "our"), governing your use of our website and our vehicle purchasing-assistance, freight forwarding, inland transportation, and international ocean shipping services. By requesting a quote, registering an account, placing a bid through us, or using our services in any way, you agree to these Terms. If you do not agree, please do not use our services.

1. Who We Are & What We Do

Baltic Auto Shipping, Inc. is a licensed NVOCC and freight forwarder based at 5811 W 66th St., Bedford Park, IL 60638, United States. We assist customers with bidding on and purchasing vehicles through third-party auto auctions, inland transportation, export documentation, and international ocean shipping to destinations worldwide.

We are not an auction. We do not own, sell, grade, repair, or guarantee any vehicle, and we do not inspect vehicles except where a paid inspection service is separately requested and confirmed (see Section 2). When we assist you with an auction purchase, we act as your agent or bidding facilitator only. The auction itself — for example Copart, IAA (Insurance Auto Auctions), Manheim, or any other auction or private seller — is the seller of the vehicle, and that auction's own membership, buyer, and sale terms and conditions govern the sale, title transfer, condition disclosures, and any dispute about the vehicle itself. Nothing in these Terms makes Baltic Auto Shipping a party to, or a guarantor of, that sale.

2. Auction Purchases Through Baltic Auto Shipping

Where we place bids or complete a purchase on your behalf at an auto auction, the following apply, consistent with the standard terms used across the auction industry (including Copart, IAA, and Manheim):

  • Vehicles are sold "AS-IS, WHERE-IS." Auctions sell vehicles without any warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose. Neither the auction nor Baltic Auto Shipping guarantees the accuracy or completeness of any condition report, damage description, odometer reading, run-and-drive status, or photograph provided by the auction or seller.
  • We do not physically inspect vehicles before bidding unless a paid inspection service is separately requested and confirmed. We rely on the listing information published by the auction, the same as you do.
  • Bids are final once placed and, if winning, are a binding purchase obligation under the auction's own rules. We are not responsible for outbid situations, buyer's premiums, auction fees, sale cancellations, postponements, title delays caused by the auction or seller, or a vehicle being pulled from sale.
  • Title and paperwork issues, storage fees, and grading disputes are handled under the applicable auction's own policies. We will assist and advocate for you where we reasonably can, but the auction's decision is final and Baltic Auto Shipping assumes no liability for it.
  • Payment deadlines are set by the auction, not by us, and are typically short (often 1–3 business days). Missing an auction's payment deadline can result in storage fees, relisting fees, or forfeiture of the vehicle and any deposit, for which you remain responsible.

3. Customer Verification & Trade Compliance

Customer verification is a standard condition of doing business with Baltic Auto Shipping. It is carried out in the ordinary course of our business and to comply with applicable U.S. trade laws and third-party requirements, including:

  • the Export Administration Regulations, administered by the U.S. Department of Commerce, Bureau of Industry and Security;
  • the Foreign Trade Regulations, administered by the U.S. Census Bureau, which require an electronic export filing identifying the exporter and ultimate consignee for every used vehicle exported from the United States, regardless of value;
  • U.S. Customs and Border Protection requirements governing the export of used vehicles, including presentation of title or other proof of ownership prior to export;
  • U.S. economic sanctions administered by the U.S. Department of the Treasury, Office of Foreign Assets Control (OFAC); and
  • the registration requirements of the auctions at which we purchase on your behalf.

Documentation. As a condition of opening an account, and before we place a bid, complete a purchase, or accept a shipment on your behalf, you agree to provide:

  • if you are an individual, a current and valid government-issued photo identification, such as a passport, driver's license, or national identity card;
  • if you are a company or dealer, business registration documents, a tax identification or EIN number, and identification for each person authorized to act on your behalf;
  • a completed customer registration form and, where an auction so requires, a bidding authorization or power of attorney appointing Baltic Auto Shipping as your agent; and
  • documentation confirming the source of funds for a payment, where requested by our bank, an auction, a carrier, or a government authority, where required by applicable law, or where we reasonably consider it necessary.

Accuracy and updates. You represent and warrant that all information and documentation you provide to us is true, accurate, complete, and current, and you agree to notify us promptly of any change. Verification is conducted when your account is opened and on an ongoing basis thereafter, and we may request updated or additional documentation at any time.

Sanctions and export compliance. By using our services, you confirm, on an ongoing basis, that you are not named on any U.S. restricted-party list — such as OFAC's Specially Designated Nationals and Blocked Persons List, or the Commerce Department's Denied Persons List, Entity List, Unverified List, or Military End-User List.

Suspension of services. If any documentation required under this Section is incomplete, inaccurate, or not provided within a reasonable time, or if a bank, auction, carrier, or government authority requests further information, we may suspend any bid, purchase, or shipment until the matter is resolved. We shall not be liable for any delay resulting from such suspension, and any storage, demurrage, or other charges incurred as a result remain your responsibility. We will not proceed with any transaction that is prohibited by applicable law.

Handling of your information. Documentation provided under this Section is handled in accordance with our Privacy & Cookie Policy.

4. Payments

Unless otherwise agreed in writing:

  • A deposit is required before we place a bid or confirm a purchase on your behalf. Once a bid you authorized has won, the deposit is non-refundable, because it is used to satisfy the auction's own binding payment obligation.
  • If a bid you authorized is unsuccessful, your deposit remains as a credit on your account and may be applied to a future bid or purchase. You may request a refund of that credit at any time; refunds are issued less any bank or transfer fees and less any amounts you already owe us.
  • The remaining balance for the vehicle, our service fees, and any applicable shipping charges must be paid in full before the vehicle is released, transported, loaded, or shipped, and in any event before the auction's own payment deadline (see Section 2).
  • We accept wire transfer and other payment methods we make available from time to time; details are provided on invoice or upon request. We are not responsible for delays, fees, or exchange-rate differences caused by your bank or payment provider.
  • Late or incomplete payment may result in storage fees, relisting or cancellation by the auction, loss of the vehicle and deposit, and/or suspension of our services, all of which are your responsibility.
  • Payment for our shipping and freight forwarding services must be paid in full to avoid delays in the release of your cargo. Unpaid balances may result in your cargo being placed in storage at your expense, or a lien being placed on the vehicle or cargo, until payment is received in full.
  • General lien. You grant Baltic Auto Shipping, Inc. a general lien over any vehicle, cargo, document, or other property of yours that is in our actual or constructive possession, custody, or control, securing all amounts you owe us — whether those amounts relate to that particular shipment or to any other shipment or service. The lien survives delivery. If any amount remains unpaid 30 days after we give you written notice of the overdue balance, we may sell or otherwise dispose of the property at public or private sale and apply the proceeds against what you owe, without prejudice to our right to recover any shortfall from you.
  • All fees quoted are in US Dollars unless stated otherwise and exclude destination-country duties, taxes, and customs charges, which remain your responsibility (see Section 7).

5. Customer Responsibilities

As our customer, you agree to:

  • Review auction listings, condition reports, and photographs yourself before authorizing a bid — we do not warrant their accuracy (see Section 2);
  • Provide accurate, complete, and current personal, business, and shipping information, and complete customer verification when you open your account, keeping it up to date (see Section 3);
  • Make all payments in full and on time, including before auction-imposed deadlines (see Section 4);
  • Respond promptly to our communications regarding titles, documents, scheduling, and customs requirements;
  • Check with the destination country for its own customs rules, duties, and any port or delivery handling requirements, and confirm delivery timeframes and tracking directly with us;
  • Arrange appropriate marine cargo insurance for your shipment (strongly recommended — see the Shipping Terms below);
  • Inspect the container and vehicle promptly upon arrival and follow the claims procedure in Sections 7 and 9 if damage is found; and
  • Comply with all applicable export, import, and customs laws, and not use our services to ship prohibited, stolen, or misrepresented goods.

6. Vehicle Condition & Disclaimer of Warranties

All vehicles purchased through an auction are sold "AS-IS, WHERE-IS," WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, including any implied warranty of merchantability or fitness for a particular purpose. Baltic Auto Shipping expressly disclaims, and you release us from, any responsibility for the vehicle's mechanical condition, prior damage, title status, odometer accuracy, or compliance with the destination country's roadworthiness, emissions, or registration requirements. You are solely responsible for confirming, before you authorize any purchase, that the vehicle can be legally registered and used in its destination country.

7. Shipping Terms & Conditions

Complete the declaration fully and legibly; otherwise, the addressee may experience delay and inconvenience. A false or misleading declaration may result in a fine or the seizure of the vehicle or vehicles, or both.

You are responsible for customs and duties assessments on your shipment. You are also responsible for any attorneys' fees and legal costs we incur in connection with this shipment, on the terms and to the extent set out in Section 10 (Indemnification).

INSURING GOODS IS STRONGLY RECOMMENDED. OWNER AND/OR THEIR AGENT OF GOODS ACKNOWLEDGES THAT BALTIC AUTO SHIPPING INC (AND ITS RELATED COMPANIES) ASSUME NO RESPONSIBILITY FOR LOSS TO GOODS DUE TO THEFT, VANDALISM OR ANY OTHER DAMAGE WHILE SAID GOODS ARE STORED ON OUR PREMISES.

You are responsible for insuring your cargo at the time of shipment at your own expense with an insurance company of your choice. Additional Marine Cargo Insurance is STRONGLY recommended. The formal claim for compensation is to be filed by the shipper/Consignee directly with the Carrier/Steamship Line/Insurance Company, per the terms and conditions of the Bill of Lading/insurance policy. Separately, and in addition to that claim, written notice of the damage must be given to Baltic Auto Shipping, Inc. within the deadline set out below so that we are able to assist. Baltic Auto Shipping Inc. (and its related companies) will assist if possible. However, the claimant is ultimately responsible for the claim process.

Baltic Auto Shipping, Inc. is not liable for loss, damage, delay, misdelivery, or non-delivery caused by:

  1. Acts of Nature (such as flood, hurricane, etc.), public enemies, riots, strikes, authority of law, nuclear reaction, or radioactive contamination;
  2. Changes in the laws or regulations of the country of destination, which may result in delays in the delivery of the vehicle(s); or
  3. Improper, incorrect, or incomplete addresses or contact numbers supplied by the sender, or the receiver no longer being reachable at the phone number the sender supplied. Delays arising from these causes are the sender's responsibility, and the sender will be held responsible for any fees that result from them.

Baltic Auto Shipping, Inc. shall not be liable for the loss by the receiver or sender of any items that may be prohibited from being sent in the vehicle to the country of destination, including without limiting the generality of the foregoing, negotiable instruments, cash, precious metals, stones and jewelry and other objects that may be determined by the regulating officials of the country of destination as being objects in the nature of luxury objects or any other items that were not declared as in the vehicle.

It is the duty of the sender to:

  1. Check with the destination country for its applicable customs rules to determine whether delivered vehicles are duty-free or subject to customs charges, and confirm further delivery from the destination port and/or unloading arrangements with the company providing those services in the destination country.
  2. Check with Baltic Auto Shipping, Inc. or its representative about the time frame for delivery of the vehicle to the country of destination and for further tracking of the shipment.
  3. Before sending the shipment, check with Baltic Auto Shipping, Inc., with any questions or concerns.

In case of damage discovered upon unloading, these criteria must be met, or Baltic Auto Shipping, Inc. cannot assist with or support your claim against the Carrier/Steamship Line/Insurance Company, and no compensation will be pursued on your behalf. For the purposes of these Terms, a container is treated as "unloaded" on the date it is first opened and devanned at the destination — whether at the destination port, a terminal, a warehouse, or the consignee's own premises — whichever occurs first.

  1. Written notice of the damage must be given to Baltic Auto Shipping, Inc. no later than 7 days after the container is unloaded. This notice is in addition to — not a replacement for — the formal claim you must file with the Carrier/Steamship Line/Insurance Company.
  2. Photos MUST be taken inside the container for the claim to be valid. Additional pictures can be taken after unloading to show more detailed damage, but NO claims will be accepted without the photos taken inside the container.
  3. Appraisal for the damages is helpful but not required, unless a dispute arises over the compensation amount offered by the Carrier/Steamship Line/Insurance Company.

Baltic Auto Shipping is not responsible for any damages that may occur to the container after it leaves our warehouse (including transportation on land and sea, port handling, and unloading at the destination). Such damage claims are the customer's responsibility to pursue against the Carrier/Steamship Line/Insurance Company as described above; we will assist where we reasonably can, but we are not the party that owes or pays compensation for transit damage.

All shipments are subject to inspection and/or seizure by U.S. Customs and Border Protection. Customs examination charges and carrier demurrage charges are under the shipper's responsibility. We are not responsible for rolled bookings, demurrage charges, or other additional charges that result if Customs does not return the title in time to meet the carrier's title cut-off deadline.

8. Limitation of Liability

To the fullest extent permitted by law, Baltic Auto Shipping's total liability arising out of or relating to these Terms or our services — whether in contract, tort, or otherwise — is limited to the service fees you paid to us for the specific shipment or transaction giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of use, or diminished vehicle value, even if we have been advised of the possibility of such damages. This cap limits liability that exists; it does not create liability. Where Section 7 (Shipping Terms & Conditions) excludes our responsibility entirely for a category of loss — including damage occurring after the cargo leaves our warehouse — that exclusion applies, and in the event of any conflict between Section 7 and this Section 8 in a shipping matter, Section 7 controls. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Damage Claims Procedure

If your vehicle arrives damaged, the claims requirements set out in Section 7 above govern — including the 7-day written notice to us, the requirement for photographs taken inside the container, and the definition of when a container is treated as unloaded. Those requirements are deliberately not restated here, so that there is only one controlling version of them. In short: notify us within the deadline, photograph the damage inside the container before unloading is complete, and file your formal claim with the Carrier/Steamship Line/Insurance Company under the Bill of Lading or your insurance policy. We will assist where we reasonably can, but you remain responsible for pursuing the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Baltic Auto Shipping, Inc., its officers, employees, agents, and related companies from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your breach of these Terms; inaccurate information or documentation you provided; your failure to comply with customs, export, or import laws; or any dispute between you and an auction, seller, carrier, or insurer.

11. Cancellations

Once we have placed a winning bid or made a purchase on your behalf, the transaction is generally binding under the auction's own rules and cannot be cancelled or refunded by us, because we have already incurred a binding payment obligation to the auction. Requests to cancel before a bid is placed may be accommodated at our discretion. Shipping bookings that are cancelled after cargo has been booked, loaded, or is in transit may be subject to cancellation, storage, or demurrage fees charged by the carrier or terminal, which will be passed on to you.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Illinois and applicable United States federal law, including maritime law where it applies to ocean carriage, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts. Nothing here limits your rights under a Bill of Lading or a carrier's or insurer's own dispute process.

13. Force Majeure

Neither party is liable for any delay or failure to perform its obligations under these Terms — other than an obligation to pay money already due — where that delay or failure is caused by an event beyond its reasonable control. Such events include, without limitation: acts of nature, flood, hurricane, earthquake, fire, or severe weather; war, invasion, terrorism, civil unrest, or riot; strikes, lockouts, or other labor disputes, whether involving our workforce or that of a port, terminal, carrier, or auction; epidemic or pandemic and any related public-health measure; port, terminal, canal, or border closure or congestion; vessel or equipment shortage, schedule change, blank sailing, rolled booking, or carrier default; any act, order, embargo, sanction, inspection, seizure, or licensing decision of a government, customs, or regulatory authority; failure or interruption of utilities, telecommunications, payment systems, or the platforms of any auction; and cyberattack or other malicious interference with information systems.

Where such an event occurs, the affected party's obligations are suspended for as long as the event continues and to the extent it is affected, and the time for performance is extended accordingly. The affected party will notify the other as soon as reasonably practicable, will use reasonable efforts to limit the effect of the event, and will resume performance as soon as it is able.

Amounts remain payable. A force majeure event does not excuse you from paying amounts already due, and it does not excuse storage, demurrage, detention, re-booking, or similar charges imposed by a port, terminal, carrier, or auction as a result of the event. Those charges are passed through to you and remain your responsibility under Section 4.

If a force majeure event prevents performance of a service for more than one hundred and twenty (120) consecutive days, either party may terminate that affected service on written notice. On termination you remain liable for services already performed and for third-party costs already incurred on your behalf, and any remaining account balance is settled between us.

This section supplements, and does not limit, the exclusions in Section 7 (Shipping Terms & Conditions). Where a shipping matter falls under both, Section 7 controls, consistent with Section 8.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, the auction industry, or applicable law. When we do, we will revise the "Last updated" date above. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
